Religious democracy is a form of government that gives the will and vote of the people a central place in the political destiny. Regarding the position of the people in the religious government, several theories have been presented such as legitimizing, being a factor of acceptability, being a form of government, or being the support of government, and some have considered it paradoxical. These views are either due to the confusion between the two concepts of value and legitimacy, or they failed to distinguish between them correctly. In this article, by presenting the theory (divine legitimacy-democracy value) while expressing the characteristics of legitimacy, we discuss the type of value of democracy and its accessories. The logical components of this theory are: 1- Criticism and modification of the will of the people, 2- Fallibility, 3- Complementability, 4- Constraintability, 5- Necessity to respect the limits of justice, 6- Preferability, 7- Structureability, 8- Necessity of situation-research, 9- Mandatory. Based on this realistic view, the conflict of democracy with matters such as divine will, principles of justice and people's interests is resolved.
