Āyatollāh Sistāni and the Theory of Nation Will

Abstract

For the answer to the question about jurisprudential foundation underlying Āyatollāh Sistāni’s policy, there is little analysis which are mostly focused on just description of his political behavior. An investigation of jurisprudential references as well as his ideas shows that between the views of Āyatollāh Khoyi and Imām Khomeini which send Mujtahidin to the government, he returns to the doctrine of Mirzā Nā’ini in the Tanbih al-Ummah wa Tanzil al-Millah (the admonition of people and the refinement of sharia). Returning to Nā’ini’s idea is needed in Iraqi society today that its principles are accurately reconstructed not in a monarchy but a democratic system. Āyatollāh Sistāni. Similar to Nā’ini, supports a contract between the people and the governor; however, reconstructs the theory with three changes in the republican assembly. The research method is a combination of descriptive, explanatory, and analytical methods that re-read and analyze the intellectual doctrine of Āyatollāh Sistāni in these three stages. His political ideology is slightly different from the doctrine of Āyatollāh Khoyi and Imām Khomeini and somehow in the middle. However, like many other thinkers in Najaf seminary, he isalso influenced  by the norms that have been  prevalent in this field over the last one or two centuries. The norms that were mostly established by Sheikh Mortezā Ansāri, and then Akhound Khorāsāni, and his student Mirzā Nā’ini. Indeed, Āyatollāh Sistāni under the influence of this movement has been able to revisit the doctrine of Nā’ini and accordingly back up a civil government in Baghdad.
