Abstract

state; A group has chosen the sharia ban on forming an Islamic state. This approach is based on the principles of non-guardianship, the need for transparency and openness, the need to be content with certainty, the need for the infallibility of the Islamic ruler and the lack of valid evidence. The principles of non-governorship, the necessity of contentment is strictly related to the claim of governorship and does not include the necessity of government. The necessity of infallibility refers to the ideal state of Islam of the state. Lack of knowledge is also addressed by consulting the institution. The lack of a valid reason to support this view can also be criticized. The emergency acceptance of the customary state is the ultimate achievement of this view. The second view is possible. This view is based on the universality, immortality, universality of Islam, the rule of denying the mustache, the necessity of practicing religion, the need to preserve the integrity of Islamic society. The result of this view is the formation of an active government in the field of domestic and international politics, culture and economy.
