The research method is descriptive-analytical, and the results indicate that authority of the U.S and France presidents in unconventional situations and crises relies on the individual so much more extensive and higher than the governmental command of Wali-e Faqih. Moreover, the supreme ruler in most political systems around the world has authority and power beyond the framework of the constitution and codified laws in order to manage society in unconventional and critical situations. However, in comparison, it can be claimed that the governmental command of Wali-e Faqih is executed after constitution as well as religious and accurate conditions such as observing interest, justice, and consultation with the Expediency Council as a consultative council. The review process of the U.S and Republic of France constitution shows lack of attention to people’s political participation in the realm of power in those countries because the role of public vote is neglected in major decisions and constitution as the national covenant هدف پژوهش حاضر بررسی تطبیقی حکم حکومتی ولی‌‌فقیه با اختیارات ویژه رؤسای جمهور آمریکا و فرانسه در شرایط نامتعارف است. روش پژوهش توصیفی- تحلیلی بوده و نتایج حاکی از آن است که اختیارات رؤسای جمهور آمریکا و فرانسه در شرایط نامتعارف و بروز بحران، قائم به شخص بوده و بسیار فراتر و گسترده‌‌تر از حکم حکومتی ولی‌‌فقیه است. مضافاً اینکه، عالی‌‌ترین مقام در اغلب نظام‌‌های سیاسی دنیا، از اختیارات و اقتداری فراتر از چارچوب قانون اساسی و قوانین مدون برای مدیریت جامعه در شرایط غیرمتعارف و بحرانی برخوردار است، لیکن در مقام مقایسه می‌‌توان ادعا کرد، که حکم حکومتی ولی‌‌فقیه در چارچوب قانونی و با ضوابطِ شرعیِ دقیق، مانند رعایت مصلحت، عدالت و با مشاورت مجمع تشخیص مصلحت نظام- به‌‌عنوان مجمع مشورتی- اعمال می‌‌گردد. فرایند بازنگری در قانون اساسی ایالات متحده آمریکا و جمهوری فرانسه، نشان‌‌دهنده عدم توجه به مشارکت سیاسی مردم در عرصه قدرت در آن کشورها دارد؛ زیرا، نقش آرای عمومی در تصمیمات کلان کشوری و قانون اساسی به عنوان سند میثاق ملی، نادیده گرفته می‌‌شود. http://sm.psas.ir/article_703210_c95400b07bd7d09bc10bf2f09405ffc1.pdf
