In this regard descriptive analysis was used to survey the principles of political thinking, relationship between Seyed Ja’far Kashfi and Fath Ali Shah Qajar, necessity of government, various forms of government, and the characteristics of a ruler from his viewpoint. The results showed that Seyed Ja’far Kashfi, setting some strict conditions for the characteristics of a ruler jurist, did not acknowledge any of the jurists in his age as a qualified candidate for this position. This viewpoint is enough for him to defend the theory of simultaneous chairmanship of 2 learned scholars or twin rulers for the matter of norms and religious issues in society. In his view, a fair king would govern the worldly affairs as his validity and legitimacy exclusively comes from the Treaty of Malek Ashtar; and a jurist would govern religious affairs such as Hesbi issues (charity), judgement, mortmain property and so on. This theory that was also considered in later periods, is somehow a foundation for constitutionalism because it defends the authority of a king to govern the civil affairs not definitely mentioned in the Qur’anic verses (Gheyr-Mansusat) and the authority of a jurist to implement the definite rules in the Qur’an (Mansusat). هدف پژوهش حاضر بررسی سرشت دولت در عصر غیبت از دیدگاه سیدجعفر کشفی، یکی از علمای شیعه عصر فتحعلی شاه قاجار می‌باشد. در این راستا و با روش توصیفی- تحلیلی، ارکان تفکر سیاسی، روابط سیدجعفر کشفی با فتحعلی شاه قاجار، ضرورت وجود دولت و انواع دولت و ویژگی‌های حاکم از منظر وی مورد بررسی قرار گرفت. نتایج حاصل نشان داد، سید جعفر کشفی با طرح شرایط سخت‌گیرانه‌ای پیرامون اوصاف فقیه حاکم، هیچ یک از فقیهان عصر خود را نامزد چنین منصبی نمی‌داند. همین نگاه کافی است تا کشفی از نظریه ریاست افاضل یا ریاست دو حاکمی بر عرفیات و شرعیات دفاع کند. از دیدگاه او سلطان عادل بر امور دنیوی حکومت می‌کند و اعتبار و مشروعیت را به طور خاص از عهدنامه مالک اشتر می‌گیرد و فقیه نیز بر امور شرعی مانند امور حسبیه و قضاوت و اداره موقوفات و غیره تصرف دارد. این نظریه که با عناوین متعددی در دوره‌های بعد مورد توجه قرار گرفت، به نوعی بنیان نظریه مشروطه نیز به حساب می‌آید، چرا که مشروطیت از زعامت سلطان بر حوزه غیرمنصوصات و تصرفات فقیه در حوزه منصوصات دفاع می کرد. http://sm.psas.ir/article_239906_6314361d48d78f434b0e37c53c8856d9.pdf
