انجمن مطالعات سیاسی حوزه سیاست متعالیه 2345-2676 3 9 2014 09 01 Conceptual Analysis of “Baghi”, “Muharebah” and “Civil Disobedience” بررسی مفهومی «بغی»، «محاربه» و «نافرمانی مدنی» 131 151 20047 FA سید جواد ورعی Journal Article 2016 06 03 The present paper has analyzed the lexical and metaphorical meaning and concept of three terms of “Baghi” ( بغی ; rebelin front of the Imam), “Muharebah” ( محاربه ) and “Civil Disobedience” to prevent from mixing them which itself results in making mistake in issuing verdict, wastage of rights and oppressing government and people. This analysis shows that the three concepts of “Baghi”, “Muharebah” and “Civil Disobedience” are different both from the lexical aspect and from the metaphorical side. The method of the study, which is responsible for recognizing the similar juridical concepts used in political and legal affairs, has been descriptiveanalytical; and lexical, juridical and sometimes legal and political resources have been used. On basis of the analysis, though being different, the two terms of “Baghi” and “Muharebah” are criminal terms. On the other hand, “resistance and civil disobedience”is, at times, a civil right or even duty; although it can be crime sometimes, but it has a great difference with the above-mentioned criminal terms. مقاله حاضر به بررسی معنا و مفهوم لغوی و اصطلاحی سه عنوانِ «بغی»، «محاربه» و «نافرمانی مدنی»  پرداخته است تا خلط میان آ نها موجب اشتباه در صدور حکم، و تضییع  حقوق و ستم به دولت و مردم نشود. این بررسی نشان می دهد که سه عنوانِ بغی، محاربه و نافرمانی مدنی هم از نظر لغوی و هم از نظر اصطلاحی با یکدیگر متفاو تاند. روش بحث در این نوشتار، که عهد هدار شناسایی مفاهیمِ مشابه فقهی که در عرصه حقوقی و سیاسی هم کاربرد دارند، توصیفی تحلیلی بوده و از منابع لغوی، و فقهی و در برخی موارد، حقوقی و به رغم « محاربه » و « بغی » سیاسی استفاده شده است. بر اساس این بررسی، دو عنوانِ در پاره ای « مقاومت و نافرمانی مدنی » تفاوتی که دارند، عناوینی مجرمان هاند. در حالی که موارد، حق و حتی تکلیف شهروندی است؛ اگرچه در برخی از موارد هم م یتواند جرم باشد، اما با عناوین مجرمانه فوق، تفاوت بسیاری دارد. http://sm.psas.ir/article_20047_a52168f7d6bd25d2d4e7f6a927ce5977.pdf
