The purpose of the present study is to assess the proportion between each of the above principles and the principle of justice. The issue under study is: which method has state legitimacy based on the principle of divine justice? By using descriptive analysis and searching through epistemic data in Islamic Kalām, and also recognizing aspects and features of domination, testaments, and consensus based on historic, political, and legal ideas and reports, it can be asserted that domination by any means can give legitimacy to a government just in case kingdom from God as the divine destiny is accepted and that admittance of that is the result of faith and obedience to God. State legitimacy based on testament relies on the hypothesis that statesmanship is regarded as the transferable right of a prince. The principle of justice considers any cruel command invalid and illegitimate. Imposing a state and a leader on people based on domination or inheritance is great tyranny due to independent reasons. Therefore, the necessity of establishing a state based on people's votes results from the principle of divine justice and that ignoring public opinion and imposing a state by either force or deceit violates the principle of justice.}, keywords = {State Legitimacy,Domination,Wilāya-e 'Ahd (Guardianship of the Prince),Religious Democracy,Divine justice,will,People' Consensus}, title_fa = {اصل عدل الهی و نظام مبتنی بر مردم‌سالاری دینی}, abstract_fa = {همواره زمامداری بر یکی از سه اساس تغلّب، وصیّت و رضایت مردم شکل گرفته است. هدف پژوهش حاضر، نسبت‌سنجی هر یک از این سه، با اصل عدل است. مسأله مورد پژوهش آن است که بر پایه اصل عدل الهی، کدامین طریق برای تحقق حکومت، مشروعیت دارد؟ با روش توصیفی- تحلیلی و بررسی داده‌های معرفتی حوزه کلام اسلامی، و نیز شناخت ابعاد و خصائص سه‌گانه تغلّب، وصیت و رضایت بر پایه گزارش‌های تاریخی و اندیشه‌های سیاسی- حقوق اساسی می‌توان گفت، چیرگی به هر وسیله ممکن، از آنجایی می‌تواند به حکومتی مشروعیت ببخشد که اعطاء مُلک از سوی خداوند را تقدیر الهی بپنداریم که پذیرش آن نتیجه ایمان و تسلیم در برابر خداوند است. مشروعیت حکومت بر پایه وصیّت، براساس آن است که زمامداری را حق قابل انتقالِ زمامدار بپنداریم. اصل عدل هر حکم ستمکارانه‌ای را نامعتبر و نامشروع می‌شمرد. تحمیل زمامداری و زمامدار بر پایه چیرگی، فریب یا عهد و وراثت بر مردمان، به حکم عقل مستقل، ستمی بزرگ است. بنابراین، ضرورتِ تشکیل حکومت بر پایه آراء مردم از نتایج اصل عدل الهی بوده و نادیده گرفتن افکار عمومی و تحمیل زمامداری به زور یا فریبکاری، نقض اصل عدل خواهد بود. امام علی(ع) در آغاز و ادامه دوره زمامداری خویش همواره بر مشروعیت زمامداری براساس رضایت عموم مردم تاکید داشت. بر این اساس، سامانه مبتنی بر رضایت مردم، تنها مجرای تحققِ مشروعِ زمامداری اولیای الهی خواهد بود.}, keywords_fa = {مشروعیت حکومت,تغلّب,ولایت عهد,مردم‌سالاری دینی,عدل الهی,وصیّت,رضایت مردم}, url = {https://sm.psas.ir/article_700890.html}, eprint = {https://sm.psas.ir/article_700890_d210da2263622af71177770e7a05f21f.pdf} }
