Although from the viewpoint of Imam Khomeini, “the necessity of maintaining of the government” – which can be considered as a general verdict or an important juridical principle – has been numerated among the “absolute necessities”, but the questions “what is government?” and “Is the necessity of maintaining it, specially maintaining the political government, absolute or conditioned?” are to be discussed in this paper by referring to Imam Khomeini’s viewpoints. This research has been done based on data collection, description and data analysis, adapting the viewpoints and sometimes critique and analysis. The presupposition of the researcher is that if Imam Khomeini’s intention by “Government” was “Islamic Government”, maintaining it is absolutely necessary but if his intention was “political government”, maintaining it would be conditionally necessary. Also, from Imam Khomeini’s point of view, maintaining the Islamic Republic government, conditioned to loyalty to its aims and targets which are based on religious bases and didactics, will be considered as equal to maintaining Islam.}, keywords = {Maintaining the Government,Disorder of the Government,Islamic Government,Political Government,Absolute and Conditioned Necessity,Imam Khomeini}, title_fa = {حفظ نظام، واجبی مطلق یا مشروط؛ با رویکردی به اندیشه‌ی سیاسی امام خمینی(ره)}, abstract_fa = {در ابواب گوناگون فقهی، همواره بر ضرورت حفظ نظام عام اجتماع، حدود و ثغور بلاد اسلامی و نظام سیاسی تأکید، و در مقابل، بر تحریم «اختلال نظام» حکم داده شده است. اگرچه از دیدگاه امام خمینی(ره) «وجوب حفظ نظام» - که به‌عنوان یک حکم کلی یا قاعده‌ی مهم فقهی قابل طرح است - از «واجبات اکیده» شمرده شده است؛ اما این‌که «نظام» به‌چه‌معنی است و وجوب حفظ آن، به‌ویژه نظام سیاسی، واجبی «مطلق» است یا «مشروط»؟ پرسشی است که در این مقاله با محوریت دیدگاه ایشان مورد بررسی قرار خواهیم داد. این تحقیق بر اساس روش جمع آوری، توصیف و تحلیل و سامان‌دهی، تطبیق آرا و در مواردی نقد و بررسی صورت گرفته است. فرضیه‌ی نویسنده این است که اگر مراد امام خمینی(ره) از نظام، «نظام اسلام» بوده باشد، وجوب حفظ آن مطلق است؛ اما اگر منظور ایشان «نظام سیاسی» است، حفظ آن واجب مشروط خواهد بود. هم‌چنین از دیدگاه امام خمینی(ره) حفظ «نظام جمهوری اسلامی» ـ مشروط بر پای‌بندی به اهداف و آرمان‌های خود که بر مبانی و آموزه‌های دینی استوار شده است ـ در حکم حفظ نظام اسلام است.}, keywords_fa = {حفظ نظام,اختلال نظام,نظام اسلام,نظام سیاسی,واجب مطلق,واجب مشروط,امام خمینی(ره)}, url = {https://sm.psas.ir/article_25500.html}, eprint = {https://sm.psas.ir/article_25500_45ba5a96e16d00d22275ca4d7953c6a0.pdf} }
