The increasing prominence of environmental issues has driven governments in a direction whereby, without due consideration of environmental requirements and objectives, they cannot make informed decisions. Therefore, within a framework of good governance, the alignment of legal obligations, international cooperation, and social leadership is directed toward the preservation of the environment as well as the prevention and reduction of its potential damages. In this regard, the objective of the present study is to critically examine international treaties and domestic environmental laws and to answer the question: “Have the environmental laws ratified in the Islamic Republic of Iran led to the enhancement of the components of good governance?” The research method was descriptive-analytical. A review of the evolution and enactment of environmental laws in Iran before and after the Islamic Revolution—along with an examination of the most significant international actions in the ratification of global treaties and conventions for environmental preservation, as well as the degree of the Islamic Republic of Iran’s participation in these international environmental treaties and the structure of the institutions responsible for the environment in the country—has shown that environmental laws within the Islamic Republic’s system have neither been preventative nor adequate for the preservation of this crucial issue; the multiplicity of responsible entities and the fragmentation of laws and definitions have contributed to the continued degradation of the environment in the country. In this context, solutions such as restructuring the Supreme Council for the Environment, amending environmental laws based on the view of the environment as a “right,” giving special attention to environmental issues in the Islamic Penal Code, revising the internal regulations of the Islamic Consultative Assembly regarding the separation of environmental issues from the Agriculture Commission into an independent specialized commission, enhancing interaction and cooperation with international conventions, and reaching a consensus on commitment to environmental obligations have been proposed to improve the efficacy of the laws.
